Please read these Terms of Service carefully before using any Oceanic service or platform. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, you must not access or use our services.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Customer", "you") and Oceanic Consulting VOF, a private professional partnership registered in the Netherlands under Chamber of Commerce (KVK) number 84553081, with its registered address in Poortugaal, Netherlands ("Oceanic", "we", "us", "our").
These Terms apply to all services, software, platforms, APIs, websites, and digital products operated by Oceanic or its ventures, including but not limited to:
These Terms govern your use of all the above unless a separate written agreement exists between you and Oceanic for a specific service, in which case that separate agreement takes precedence.
Oceanic provides technology platforms and consulting services including enterprise AI tooling, AI-powered travel planning, eSIM and mobile connectivity products, private internet access services, and telecom consulting engagements. The specific features and capabilities of each platform are described on the respective product website and may change over time.
Oceanic may offer features or services designated as "beta", "preview", or "experimental". Such features are provided without warranty and may be discontinued, modified, or limited at any time without prior notice. Beta features are excluded from standard SLA commitments.
Our platforms may integrate with or link to third-party services (including AI model providers, payment processors, mapping services, and eSIM network operators). We are not responsible for the performance, availability, or practices of third-party services. Your use of third-party services is governed by their respective terms and privacy policies.
You must be at least 18 years of age (or the applicable age of legal majority in your jurisdiction) and have legal capacity to enter into binding agreements. By creating an account, you represent and warrant that you meet these requirements.
You agree to provide accurate, complete, and current registration information. You are responsible for maintaining the accuracy of your account information and for updating it promptly if it changes. Providing false or misleading information is grounds for immediate termination of your account.
You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must:
Oceanic will not be liable for any loss or damage arising from your failure to comply with these obligations.
If you register on behalf of a legal entity, you represent and warrant that you have authority to bind that entity to these Terms, and all references to "you" shall include both you and the entity.
Your use of Oceanic services is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. You agree at all times to comply with that policy.

Violation of this clause may result in immediate suspension or termination of your account without refund.
Access to certain Oceanic services is provided on a subscription basis. Subscription plans, pricing, and included features are described on the relevant product website and are subject to change with 30 days' advance notice to existing subscribers.
All fees are quoted and invoiced in Euros (EUR) unless otherwise specified. Payment is due in advance for each subscription period. By providing a payment method, you authorise Oceanic or our payment processor to charge all applicable fees on the billing date.
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel at any time through your account settings or by contacting billing@oceanicco.nl. Cancellation takes effect at the end of the current billing period; no partial-period refunds are issued unless required by applicable law or covered under our Refund Policy.
Prices are exclusive of applicable taxes, including VAT/BTW, unless expressly stated otherwise. You are responsible for paying all applicable taxes, levies, or duties imposed by any governmental authority. For EU B2B transactions, the reverse charge mechanism applies where applicable.
Oceanic reserves the right to suspend access to services for accounts with overdue balances. We will provide at least one payment reminder before suspension. Accounts suspended for non-payment may be reinstated upon payment of all outstanding amounts plus any applicable late fees.
For one-time purchases (including eSIM data packages and pay-as-you-go products), charges are applied at the time of purchase and are non-refundable unless expressly stated in our Refund Policy or required by applicable consumer protection law.
All intellectual property rights in Oceanic's platforms, software, content, documentation, trademarks, logos, and brand materials are owned by or licensed to Oceanic Consulting VOF. Nothing in these Terms grants you any rights to Oceanic's intellectual property except the limited right to use our services as set out in these Terms.
You retain all ownership rights in content you submit, upload, or create through Oceanic platforms ("User Content"). By submitting User Content, you grant Oceanic a non-exclusive, worldwide, royalty-free licence to process, store, and transmit your User Content solely to the extent necessary to provide you with the services you have requested.
If you provide feedback, suggestions, or ideas about our services, you grant Oceanic a perpetual, irrevocable, royalty-free licence to use such feedback for any purpose without obligation or compensation to you.
You may not copy, reproduce, modify, distribute, display, perform, or create derivative works of any Oceanic content or software without prior written consent. Unauthorised use of Oceanic trademarks or brand materials is strictly prohibited.
Oceanic processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Dutch data protection law. Our full Privacy Policy is available at oceanicco.nl/privacy.
Where Oceanic processes personal data on your behalf as a data processor (for example, when you use Hubrix AI to process documents containing personal data of your customers), we will enter into a Data Processing Agreement with you upon request. Please contact privacy@oceanicco.nl.
We do not sell your personal data to third parties. We maintain appropriate technical and organisational measures to protect personal data against unauthorised access, loss, or destruction.
Oceanic targets a monthly uptime of 99.5% for production services. This target excludes scheduled maintenance windows, events caused by third-party infrastructure (including cloud providers and AI model APIs), force majeure events, and any outages resulting from your own actions or third-party services under your control.
We reserve the right to take services offline for scheduled maintenance. We will endeavour to perform maintenance during low-traffic periods and to provide advance notice where reasonably practicable. Emergency maintenance may be performed without prior notice.
Oceanic reserves the right to modify, update, or discontinue any feature or service at any time. For material changes that adversely affect existing subscribers, we will provide at least 30 days' advance notice.
To the maximum extent permitted by applicable law, Oceanic's services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
AI-generated content produced by Oceanic platforms (including itinerary suggestions, research outputs, and automated analyses) may contain errors or inaccuracies. You are responsible for independently verifying any AI-generated output before relying on it for commercial, medical, legal, or other high-stakes decisions.
To the maximum extent permitted by law, Oceanic's total cumulative liability to you for all claims arising under or in connection with these Terms — regardless of the form of action — shall not exceed the greater of (a) the total fees paid by you to Oceanic in the three (3) months immediately preceding the event giving rise to the claim, or (b) €100.
Oceanic shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or damages for loss of profits, revenue, data, business, or goodwill — even if we have been advised of the possibility of such damages.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable Dutch or EU consumer protection law, including the statutory warranties and rights available to consumers under Directive 2019/771 and Dutch civil law.
You agree to indemnify, defend, and hold harmless Oceanic Consulting VOF and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
These Terms remain in effect for as long as you have an active account or use any Oceanic service.
You may terminate your account at any time by contacting support@oceanicco.nl or through your account settings. Termination does not entitle you to a refund of any prepaid fees except as set out in the Refund Policy.
Oceanic may suspend or terminate your account with immediate effect and without prior notice if you:
For less serious breaches, Oceanic will where possible provide notice and a reasonable opportunity to remedy the breach before suspension or termination.
Upon termination, your right to access and use all Oceanic services ceases immediately. We will retain your data in accordance with our Privacy Policy and applicable law. You may request export of your data before termination; after termination, data retrieval may not be possible.
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Rotterdam, the Netherlands, unless mandatory consumer protection laws in your country of residence provide otherwise.
If you are a consumer resident in the European Union, you may use the EU Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr to resolve disputes. Our contact email for ODR purposes is legal@oceanicco.nl.
Oceanic reserves the right to amend these Terms at any time. When we make material changes, we will notify you by email (to the address registered to your account) and by posting a notice on the relevant platform at least 14 days before the changes take effect. Your continued use of our services after the effective date of changes constitutes acceptance of the updated Terms.
If you do not agree to the amended Terms, you may terminate your account before the effective date in accordance with Section 11.2. Prepaid fees for periods after termination will be refunded in accordance with our Refund Policy.
These Terms, together with the Privacy Policy (GDPR), Acceptable Use Policy, and Refund Policy, constitute the entire agreement between you and Oceanic regarding your use of our services and supersede all prior agreements, representations, and understandings.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed and shall not affect the validity and enforceability of the remaining provisions.
Oceanic's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
You may not assign or transfer your rights or obligations under these Terms without Oceanic's prior written consent. Oceanic may assign these Terms or any rights thereunder without restriction.
Oceanic shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, acts of government, war, pandemic, internet infrastructure failures, or third-party service outages.
These Terms are provided in English. In the event of any conflict between a translated version and the English version, the English version prevails.
